M & J Pro Touch Cleaning Services, LLC - Terms of Service

1. Agreement

These Terms of Service ("Agreement") govern the relationship between M & J Pro Touch Cleaning Services LLC ("Company," "we," "us," or "our") and you ("Client," "you," or "your") regarding your use of our commercial and residential cleaning services ("Services"). By using our Services, you agree to be bound by this Agreement.

2. Services Provided

We provide commercial and residential cleaning services as described on our website or in a separate service agreement. Specific services to be provided, frequency, and any special instructions will be agreed upon prior to the commencement of services.

3. Booking and Scheduling

Scheduling: Service dates and times are subject to availability. We will make reasonable efforts to accommodate your preferred schedule.

Rescheduling/Cancellation: You may reschedule and/or cancel a scheduled service providing us at least a 24 hour-notice. Our cancellation fees is just $50 USD. If less than 24 hour-notice is given then you may be charged up to 50% of the total service cost.

Lockouts: If our cleaning team is unable to access your property due to your fault (e.g., incorrect key, no access code), a lockout fee may apply.

4. Payment

Pricing: Service fees are based on the size of the property, the type of cleaning service, and any additional services requested. Pricing will be provided in advance.

Payment Methods: We accept the following payment methods: cash, zelle, paypal, and cash app.

Payment Due Date: Payment is due 24 hous after completion of services unless otherwise agreed in writting.

Late Fees: Late payments may be subject to a late fee of $15 USD per month.

Returned Checks: A fee of $35 USD will be charged for returned checks.

5. Client Responsibilities

Access: You must provide us with access to your property on the scheduled service date and time.

Utilities: You must ensure that water and electricity are available at the property.

Valuables: You are responsible for securing or removing valuable, fragile, or irreplaceable items. We are not responsible for damage to items not secured or removed.

Pets: Please secure pets during the cleaning service to ensure their safety and the safety of our cleaning team.

Hazardous Conditions: You must inform us of any hazardous conditions or materials present at the property.

6. Our Responsibilities

Quality Service: We will perform the Services in a professional and diligent manner.

Insurance: We maintain general liability insurance.

Trained Personnel: Our cleaning team is trained and background-checked.

7. Damage and Loss

Reporting: You must report any damage or loss within 24 hours of the service completion.

Liability: Our liability for damage or loss is limited to the repair or replacement cost of the damaged item, up to a maximum of $250 USD. We are not liable for pre-existing damage or conditions.

Exclusions: We are not liable for damage caused by faulty or improperly installed items, or for damage caused by natural wear and tear.

8. Termination

Either party may terminate this Agreement with 7 days by written notice. We reserve the right to terminate this Agreement immediately if you breach any of its terms.

9. Confidentiality

We will keep your personal information and property details confidential.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

11. Dispute Resolution

Any disputes arising under this Agreement shall be resolved through Mediation in Palm Beach County, FL.

If mediation is unsuccessful, the dispute shall then be resolved through binding arbitration, also held in Palm Beach County, FL, in accordance with applicable laws.

Both parties agree to waive the right to pursue claims in court, including the right to a jury trial, except as otherwise required by law.

12. Entire Agreement

This Agreement constitutes the entire agreement between you and M & J Pro Touch Cleaning Services LLC and supersedes all prior or contemporaneous communications and proposals, whether oral or written, relating to the subject matter hereof.

13. Amendments

We may amend this Agreement at any time by posting the amended terms on our website or providing you with written notice. Your continued use of our Services after the effective date of any amendment constitutes your acceptance of the amended terms.
